Hierarchischer Rekurs und verwaltungsgerichtliche Klage vor der Apostolischen Signatur

Abstract

Effective legal protection in administrative matters is one of the central demands of the Synodal Way. This article first reviews the three basic models of legal protection in administrative matters. It then discusses the possibilities of legal protection in administrative matters offered by canon law: hierarchical recourse and appeal to the Apostolic Signatura. The paper concludes with an outlook on how to improve the existing legal protection.
